It is the Seller and/or Home Chef responsibility to ensure that their products comply with all laws and regulations, and are allowed to be listed for sale in accordance with TheFoodCompany (TFC)’s Policies before listing the product on the Platform. For Seller and/or Home Chef convenience, TheFoodCompany (TFC) has provided below a non-exhaustive list of prohibited and restricted products that are not allowed for sale on TheFoodCompany (TFC). TheFoodCompany (TFC) will update this Policy from time to time where necessary. Please visit this page regularly for updates.

1. VIOLATION OF OUR TERMS OF SERVICE

1.1 Violations of this Prohibited and Restricted products Policy may subject the Seller and/or Home Chef to a range of actions, including but not limited to any or all of the following:

1.1.1 Listing deletion;

1.1.2 Limits placed on Account privileges;

1.1.3 Account suspension and termination; and

1.1.4  Legal action.

2. LIST OF PROHIBITED AND RESTRICTED PRODUCTS

2.1 Animal & animals related products including, without limitation, live animals, wildlife animals, mounted specimen, elephant ivory, tiger tooth amulet or any parts of animals illegal to sell and/or all endangered species provided under the law;

2.1.1 Artefacts and antiquities;

2.1.2 Used cosmetics;

2.1.3 Counterfeit currency and stamps;

2.1.4 Credit and debit cards;

2.1.5 Currency or credits including, without limitation, digital currency or credits, and stored value cards, unless expressly authorised by TheFoodCompany (TFC);

2.1.6 Drugs (including but not limited to Class “A” controlled drugs under the First Schedule of the Misuse of Drugs Act 1973 (e.g. cannabis and its derivatives such as hemp proteins, powder seeds, oil and beverages, etc., and/or opium, cocaine, ketamine, etc.), medical devices, therapeutic products (including prescription-only medicines and pharmacy-only medicines), drug-like substances and associated paraphernalia. For a list of Class “A” controlled drugs and a list of prohibited medical devices/therapeutic products.

2.1.7 Telecommunication equipment that has not been registered with the Info-communications Media Development Authority of Singapore, and electronic surveillance equipment and other similar electronic equipment such as cable TV descramblers, radar scanners, traffic signal control devices, wiretapping devices and telephone bugging devices;

2.1.8 Embargoed goods;

2.1.9 Firearms, weapons (such as pepper spray, stun guns, etc) and replicas of the same;

2.1.10 Alcohol (unless a valid licence has been submitted to, and approved by, TheFoodCompany (TFC);

2.1.11 Prohibited Food: For the safety of our Buyer and/or Seller and/or Home Chef may not list the following food and food-related products on the Platform:

2.1.12 Listings containing medicinal claims – that is, a claim that the product is intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in humans and/or animals, contraception, inducing anaesthesia or otherwise preventing or interfering with the normal operation of a physiological function, whether permanently or temporarily, and whether by way of terminating, reducing or postponing, or increasing or accelerating, the operation of that function or in any other way (for example, pharmaceutical drugs, contact lenses, misbranded dietary supplements);

2.1.13 Noxious food products – food which contains any prohibited substances or substances in excess of permitted proportions, or adulterated food without fully informing Buyer at the time of sale of the nature of the transaction;

2.1.14 Unpasteurised dairy products;

2.1.15 Wild mushrooms;

2.1.16Critically endangered or threatened species of fish, wildlife, birds and plants (including those listed at https://cites.org/eng/app/appendices.php and https://www.nparks.gov.sg/biodiversity/cites/cites-classification-of-endangered-species); and

2.1.17 Any other food products hazardous to human health.

2.2 Food not falling into the Prohibited Food category above must adhere to these minimum standards and guidelines:

2.2.1 Expiration dates – all food products must be clearly and properly labelled with an expiration or “use by” date. Expired food products must not be listed;

2.2.2 Sealed containers – all food and related products sold on the Platform should be packaged or sealed to ensure that Buyer can identify evidence of tampering or defect; and

2.2.3 Perishable food products – Seller and/or Home Chef who list perishable products should clearly identify in the product description the steps that they will take to ensure that the goods are properly packaged;

2.2.4 Government or police related products such as badges, insignia or uniforms;

2.2.5 Human parts or remains;

2.2.6 Lock-picking devices;

2.2.7 Lottery tickets;

2.2.8 Unregistered / illegal pesticides;

2.2.9 Potentially infringing products: products including but not limited to replicas, counterfeit products, and unauthorised copies of a product or product which may be in violation of any copyright, trademark, or other intellectual property rights of third parties;

2.2.10Prohibited services: the provision of services that are sexual, illegal in nature, in violation of the Terms of Service or Policies, or are otherwise prohibited at TheFoodCompany’s (TFC) sole discretion;

2.2.11 Slot machines;

2.2.12 Recalled products;

2.2.13 Shares, stock, other securities and stamps;

2.2.14 Tobacco or tobacco-related products (including without limitation electronic cigarettes and imitation tobacco products and/or accessories), as well any article or thing that, in TheFoodCompany (TFC)’s view, may induce, urge, promote or encourage the use of a tobacco product or tobacco-related product;

2.2.15 Offensive, controversial, obscene, seditious or treasonous materials;

2.2.16 Products that (a) relate to campaigns, elections, political issues, or issues of public debate, (b) advocate for or against, or attack a politician or political party, or (c) promote or encourage any form of hate, crime, prejudice, rebellion or violence;

2.2.17 Publications, books, films, videos and/or video games that do not comply with applicable laws in the country of sale and/or delivery;

2.2.18 Stolen goods;

2.2.19 Mislabelled goods;

2.2.20 Controlled Goods – All Controlled Goods permitted for sale are required to bear a Safety Mark in accordance to the Consumer Protection (Safety Requirements) Registration Scheme (CPS); 

2.2.21 Potentially explosive, flammable and/or hazardous chemicals, including all types of fireworks & firecrackers;

2.2.22 Children’s toys that pose, or that contain components that pose, ingestion hazards and/or that may potentially result in injuries (including, but not limited to, water beads, small magnetic toys and/or button batteries);

2.2.23 Any other products that are, or that contain components that are (i) illegal or restricted in the jurisdiction of the Buyer and/or the Seller and/or Home Chef or which otherwise encourage illegal or restricted activities (including, but not limited to, the sale of precious metals and/or precious stones without the relevant registrations under applicable law), or (ii) determined by any governmental or regulatory authority to pose a potential health or safety risk, or (iii) non-compliant with any applicable safety standards; and

2.2.24 Any other products that are being sold in such manner or circumstances which, in TheFoodCompany (TFC)’s view, are likely to constitute (or perpetuate or contribute to) any fraud, scam, conduct of any game of chance or lottery, or other illegal activity (including, but not limited to, raw jade stone scams, or any mystery box products incorporating a lottery-like sales model).

2.2.25 If you see a listing that violates our policies, please report it to us by clicking the “Report this Product” or “Report this User” button from the dropdown menu in the product or the user page. When a policy violation occurs, we will send an email, system message and push notification to Seller and/or Home Chefs to let them know that the listing has been removed from our Platform.
