These Terms and Conditions (“Terms”) govern the use of paid advertising services (“Paid Advertising”) offered by TheFoodCompany (“TFC”) to Seller or/and Home Chef (“Seller” or “Home Chef”). By purchasing and using our Paid Advertising services, Seller or/and Home Chef agrees to comply with these Terms. 

1. Purchase and Eligibility:

1.1 To purchase Paid Advertising services, Seller or/and Home Chef must be eligible as per the Paid Advertising Rules.

1.2 Seller or/and Home Chef must ensure their account is not suspended at the time of purchase.

2. Paid Advertising Services:

2.1 TheFoodCompany (TFC) offers Banner Advertising and Flash Deal Advertising on its Paid Advertising Site and other designated sites.

2.2 Seller or/and Home Chef agree to abide by the Paid Advertising Rules published on the site.

3. Payment and Expiry:

3.1 All Advertising Fees are subject to goods and services tax.

3.2 Paid Advertising services expire six (6) months after purchase, or as determined by TheFoodCompany (TFC).

3.3 No cancellations or refunds are allowed after the purchase and payment process is completed.

4. Flash Deal Advertising:

4.1 Seller or/and Home Chef may purchase Flash Deal Advertising services during designated periods.

4.2 TheFoodCompany (TFC) reserves the right to include nominated items in flash sales at its discretion.

4.3 Flash Deal Advertising services are non-transferable and non-refundable.

5. Listing Compliance:

5.1 Seller or/and Home Chef must ensure that listed goods comply with relevant laws, regulations, and the Paid Advertising Rules.

5.2 TheFoodCompany (TFC) reserves the right to remove listings that violate these terms without refunding any Advertising Fees.

6. Viewership and Sales:

6.1 TheFoodCompany (TFC) does not guarantee any increase in viewership or sales as a result of Paid Advertising services.

6.2 Seller or/and Home Chef are advised to consider their budget and advertising objectives before purchasing Paid Advertising services.

7. Limitation of Liability:

7.1 TheFoodCompany (TFC) shall not be liable for any compensation or losses resulting from the use of Paid Advertising services, except as provided herein.

7.2 In no event shall TheFoodCompany’s (TFC) liability exceed the amount paid by the Seller or/and Home Chef for the specific Paid Advertising service in question.

8. Disclaimer:

8.1 TheFoodCompany (TFC) does not warrant or guarantee the accuracy, completeness, or effectiveness of Paid Advertising services.

9. Governing Law:

9.1 These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.

10. Amendments:

10.1 TheFoodCompany (TFC) reserves the right to amend these Terms at any time. Seller or/and Home Chef will be notified of any changes, and continued use of the Paid Advertising services constitutes acceptance of the revised Terms.

11. By purchasing and using Paid Advertising services from TheFoodCompany (TFC) Seller or/and Home Chef acknowledge that they have read, understood, and agreed to these Terms and Conditions.
